DATA OWNER APPLICATION FORM

1. General Information

The Law on the Protection of Personal Data No. 6698 (“KVK Law”) authorizes the owner of personal data to learn whether personal data related to themselves is processed, to request information about personal data processed, getting information on the purpose of processing the personal data and whether it is used in accordance with its purpose, lear if personal data have been releaeed to third parties national and inetnationally, to get information on the third parties to which the personal data has been transferred, to request correction of personal data in case of incomplete or incorrect processing, and to request the notification of the transaction made within this scope to the third parties to whom the personal data has been transferred, request deletion destruction or anonymization of personal data and requesting notification of the transaction made within this scope to third parties to whom personal data has been transferred,  in case that personal data were processed in accordance with the provisions of the Law No. 6698 and other relevant laws, but the reason to process them is no longer valid,  to object to negative results stemming from processing data exclusively through automated systems. to demand the compensation of the damage resulting from unlawful processing.

Pursuant to the first paragraph of Article 13 of the Law on the Protection of Personal Data (KVK Law); Kimteks Tekstil İnşaat Tic. And San. A.Ş. (hereinafter referred to as the “Company”)is the data controller. Applications regarding these rights must be submitted in writing via this Personal Data Owner Application Form or other methods determined by the Personal Data Protection Council (the “Council”).

2. Application Method

In this framework, applications to be made to our company in “written” form, by printing out this form;

• With the personal application of the Applicant,
• Through a  Notary Public
• By signing with the applicant’s “secure electronic signature” defined in the Electronic Signature Law No. 5070 

The application may be forwarded to us by sending it to our company’s registered e-mail address. Explanations regarding the written application channels and the information notes to be specified in the submissions are given in the table below.

3. Situations Outside the Scope of the Right to Apply

Pursuant to Article 28 of the Law on the Protection of Personal Data  (KVK Law), personal data owners will not be able to assert their right of application, since the following cases are excluded from the scope of the Law on the Protection of Personal Data (KVK Law):

• Processing personal data for purposes such as research, planning and statistics by making them anonymous with official statistics.
• Processing of personal data for art, history, literature or scientific purposes or within the scope of freedom of expression, provided that it does not violate national defense, national security, public security, public order, economic security, privacy of private life or personal rights or does not constitute a crime.
• Processing of personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public security, public order or economic security.
• Processing of personal data by judicial authorities or execution authorities in relation to investigation, prosecution, trial or execution proceedings.
Pursuant to paragraph 2 of the Article 28 of the Law on the Protection of Personal Data  (KVK Law), it is not possible to assert the rights in the following cases, with the exception of the right to demand the compensation of the damage:
• The processing of personal data is necessary for the prevention of crime or for criminal investigation,
• Processing of personal data made public by the person concerned,
• The processing of personal data is necessary for the execution of supervisory or regulation duties and for disciplinary investigation or prosecution by the authorized and authorized public institutions and organizations and professional organizations in the nature of public institution, based on the authority given by the law,
• The processing of personal data is necessary for the protection of the economic and financial interests of the State with regard to budgetary, tax and financial matters.

6. Our Company’s Response Procedure and Time to Applications

In accordance with Article 13 of the Law on the Protection of Personal Data (KVK Law), our Company will conclude the application to our Company by the data owner as soon as possible and within 30 (thirty) days at the latest, free of charge, depending on the nature of the request. However, if the transaction requires an additional cost, the data owner may be charged  with these cost based on the fee in the tariff determined by the Council.
In order to ensure the security of your personal data, our Company may request information from the applicant for identification and authorization purposes.

The application of the personal data owner may be rejected in the following cases:
(1) Hinder the rights and freedoms of other persons
(2) Requires disproportionate effort
(3) If the information is publicly available information
(4) Compromising the privacy of others
(5) Existence of one of the situations that are out of the scope pursuant to the Law on the Protection of Personal Data (KVK Law)
